These terms of service are a legally binding contract between you and sikh time regarding your use of the service.

Please read the following terms carefully. If you do not agree with any provision of this Terms and Conditions, Please do not use Sikh Time at all.

By clicking “i accept,” or by downloading, installing, or otherwise accessing or using the service, you agree that you have read and understood, and, as a condition to your use of the service, you agree to be bound by, the following terms and conditions, including sikh time’s privacy policy (together, these “terms”).

If you are not eligible or do not agree to the terms, then you do not have our permission to use the service. Your use of the service, and sikh time’s provision of the service to you, constitute an agreement by sikh time and by you to be bound by these terms. Please note that we offer many services, in our services these terms and conditions are solely applicable. 

Your Privacy

Your privacy is important to us. Please read our Privacy policy, As it describes the types of data we collect from you and your devices (“Data”), and how we use your Data. The Privacy Statement also describes how Sikh Time uses your content, which is your communications with others; postings submitted by you to Sikh Time via the Services; and the files, photos, documents, audio, digital works, live streams and videos that you upload, books etc share through the Services (“Your Content”). 

Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that:  (a) you are at least 13 years old; If a user is below 13 years of age, it is assumed that he/she is using/browsing the concerned Platform under the supervision of his/her parent or legal guardian and that such user’s parent or legal guardian has read and agrees to the terms of this Agreement, including the terms of purchase of Products on behalf of the minor user. (b) you have not previously been suspended or removed from any Sikh Time Service. (c) your registration and your use of the Service is in compliance with any and all applicable laws and regulations. (d) If you are an entity, organization, or company (an “Organization”), the individual accepting these Terms on your behalf represents and warrants that they have authority to bind you to these Terms and you agree to be bound by these Terms.

Accounts and Registration

To access the Sikh Time services or buy any product from us, you must register for an account. You may register using your Google, Facebook, or Apple account or you may create a separate account for the Sikh Time. When you register for an account, you may be required to provide us with some information about yourself, such as your name, email address, or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. When you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. 

Payment Terms

Certain features of the Service may require you to pay fees. Before you pay any fees, you will have an opportunity to review and accept the fees that you will be charged. 

Price : Sikh Time reserves the right to determine pricing for the Service. Sikh Time will make reasonable efforts to keep pricing information published on the website up to date which is available on our pricing page (the “Pricing Page”). All prices are shown on the Pricing Page. Any applicable sales taxes, levies, value-added taxes, or duties imposed by taxing authorities are calculated during the check-out based on your location. We encourage you to check our website periodically for current pricing information. Sikh Time may change the price of any feature of the Service; if this occurs, Sikh Time will provide you advance notice of the changes before they apply. Sikh Time, at its sole discretion, may make promotional offers with different features and different pricing to any of Sikh Time’s customers. These promotional offers, unless made to you, will not apply to your offer or these Terms.

Product Availability : We list availability information for the Products on the relevant webpage of the Platforms. Beyond what we say on that webpage or otherwise on the Platforms, we cannot be more specific about availability. Please note that dispatch estimates are not guaranteed and should not be relied upon as such. As we process your order, you will be informed by e-mail and/or mobile SMS if any Products you order turn out to be unavailable or out of stock.

Products in your shopping cart of the Platforms will reflect the most recent price as displayed on the Product’s information webpage on the Platforms. Please note that this price may differ from the price shown for the Product when you first placed it in your shopping cart. Placing a Product in your shopping cart does not reserve the price shown at that time. It is also possible that a Product’s price may decrease between the time you place it in your shopping cart and the time you place the order. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery.

Authorization : You authorize Sikh Time and its third-party payment processors to charge all sums for the orders that you make and any level of Service you select as described in these Terms or published by Sikh Time, including all applicable taxes, to the payment method specified in your account. 

Subscription Service :  The Service may include automatically recurring payments for periodic charges (“Subscription Service”). If you activate a Subscription Service, you authorize Sikh Time or its third-party payment processors to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums. The “Subscription Billing Date” is the date when you purchase your first subscription to the Service. For information on the “Subscription Fee”, please see our Pricing Page. Your account will be charged automatically on the Subscription Billing Date all applicable fees and taxes for the next subscription period (e.g., monthly billing periods will be billed on the same day each month). The subscription will continue unless and until you cancel your subscription or we terminate it. You must cancel your subscription before it renews in order to avoid billing of the next periodic Subscription Fee to your account. Sikh Time or its third-party payment processor will bill the periodic Subscription Fee to the payment method you provide to us during registration (or to a different payment method if you change your payment information).

Delinquent Accounts : Sikh Time may suspend or terminate access to the Service, including fee-based portions of the Service, for any account for which any amount is due but unpaid. In addition to the amount due for the Service, a delinquent account will be charged with fees or charges that are incidental to any chargeback or collection of any unpaid amount, including collection fees.

Delivery, Returns & Refund Policy

Delivery : You will be given various options for delivery of items during the order process. The options available to you will vary depending on where you are ordering from. An estimated delivery time is displayed on the order summary page. Upon placing your order, you will receive an email containing a summary of the order and also the estimated delivery time to your location. Sometimes, the delivery may take longer due to unforeseen circumstances. In such cases, we will proactively reach out to you by e-mail and SMS. However, we will not be able to compensate for any mental agony caused due to delay in delivery.

Returns:  if you change your mind about any items purchased, you can return them to us.  All returns must be postmarked within seven (7) days of the purchase date. All returned items must be in new and unused condition, with all original tags and labels attached.

To initiate a return, you can email customer service at info@sikhtime.com or click on “Need Help” in the Order Tab on the website or mobile app. After receiving and inspecting the returned item, Sikhtime.com will process the exchange, which may take at least fifteen (15) days.

Kindly Note : You will be responsible for all return shipping charges, and it is recommended to use a trackable method for the return. International orders are not eligible for replacement or refund. 

Product Refunds : Sikhtime.com does not offer refunds for returned items. Instead of refunds, we provide exchanges for the returned items only in India. If the requested exchange product is not available in stock within 15 days, Sikhtime.com offers a Sikh Time Store Voucher equal to the order amount. The Sikh Time Store Voucher can be used for future purchases on Sikhtime.com.

Services Refunds : All Services Chargers, Membership Fee, Subscription Fee, and Payment Gateway Charges cannot be refunded at all. 

Beta Services

From time to time, Sikh Time may provide you with the opportunity to try products or services which are not generally available to users (“Beta Services”). This period of time will be referred to as the “Beta Services Period”. Beta Services will be designated as beta, pilot, non-production, evaluation, or by another description with a similar meaning. You may accept or decline an invitation at your sole discretion. You may use the Beta Services solely for evaluation purposes. By using the Beta Services, you agree to: (a) cooperate with Sikh Time in evaluating the Beta Services; and (b) provide to Sikh Time any reasonably requested feedback, comments, and suggestions for improvements.

Beta Services Usage Data : You acknowledge and agree that Sikh Time may collect anonymous data regarding usage and performance of the Service in connection with your use of the Beta Services (“Beta Services Usage Data”). Beta Services Usage Data is and will remain the exclusive property of Sikh Time. Sikh Time may use and disclose the Beta Services Usage Data for its business purposes, including to monitor, improve, and market Sikh Time’s products, provided that Sikh Time will not distribute or convey that data in a manner that could reasonably identify you as its source.

Beta Services Disclaimer :  You acknowledge and agree that the Beta Services may be inoperable or incomplete and may contain errors, design flaws, or other problems. Sikh Time is under no obligation to make any Beta Services generally available and Sikh Time may unilaterally discontinue any Beta Service at any time. Furthermore, you acknowledge and agree that you use all Beta Services at your own risk and that your use of the Beta Services may result in loss of User Content, data, or communications, project delays, or other unpredictable damage or loss. 

Ownership; Proprietary Rights

The Service is owned and operated by Sikh Time. The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, promotional content (including Sikh Time’s blog content) and all other elements of the Service (“Materials“) provided by Sikh Time are protected by intellectual property and other laws. All Materials included in the Service are the property of Sikh Time or its third-party licensors. Except as expressly authorized by Sikh Time, you may not make use of the Materials. Sikh Time reserves all rights to the Materials not granted expressly in these Terms.

Intellectual Property : If you believe any Content on the Services infringes your copyrights, you may request that remove the Content from the Services (or disable access to that Content) by emailing us on info@sikhtime.com

Third-Party Terms

Third-Party Services and Linked Websites : Sikh Time may provide tools through the Service that enable you to export information, including User Content, to third-party services, including through features that allow you to link your account on Sikh Time with an account on the third-party service. By using one of these tools, you agree that Sikh Time may transfer that information to the applicable third-party service. Third-party services are not under Sikh Time’s control, and, to the fullest extent permitted by law, Sikh Time is not responsible for any third-party service’s use of your exported information. The Service may also contain links to third party websites. Linked websites are not under Sikh Time’s control, and Sikh Time is not responsible for their content.

Third Party Software : The Service may include or incorporate third party software components, integrations, or extensions that are generally available free of charge under licenses granting recipients broad rights to copy, modify, and distribute those components (“Third-Party Components“). Although the Service is provided to you subject to these Terms, nothing in these Terms prevents, restricts, or is intended to prevent or restrict you from obtaining Third Party Components under the applicable third-party licenses or to limit your use of Third-Party Components under those third-party licenses.

User Content

User Content Generally. Certain features of the Service may permit users to upload content to the Service and send content through the Service, including messages, reviews, photos, audio, video, images, folders, data, text, graphics, and other types of information, material, and works (“User Content”) and to publish User Content on the Service. As between you and Sikh Time, you retain any copyright and other proprietary rights that you may hold in the User Content that you post to the Service. However, you acknowledge and agree that if you are an employee of an Organization, the applicable Organization may own the rights to that User Content.

User Content License Grant to Sikh Time : By providing User Content to or via the Service, your content is still yours but you grant Sikh Time a worldwide, non-exclusive, irrevocable, royalty-free, fully paid right and license (with the right to sublicense) to use, host, store, translate, transfer, display, perform, reproduce, modify, display, distribute your User Content, in whole or in part, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media, or technology, whether now known or hereafter developed, for use only in connection with the Service so we can provide you features like sharing & collaboration with an authorized user.

User Content License Grant to Other Users : By providing User Content to or via the Service to other users of the Service, including in any Workspace, your content is still yours but you also hereby grant each user a non-exclusive license to access your User Content through the Service, and to use, reproduce, distribute, display, edit, perform, and otherwise interact with such User Content, and, if you are an Administrator, Organization or a Workspace Authorized User, you also hereby grant to each other Workspace Authorized User and the Organization (if applicable) a non-exclusive license to access your User Content, and to use, reproduce, distribute, display, edit, perform, and otherwise interact with such User Content, in each case in accordance with the Service’s functionality and these Terms.

User Content Representations and Warranties. Sikh Time disclaims any and all liability in connection with User Content. You are solely responsible for your User Content and the consequences of providing User Content via the Service. By providing User Content via the Service, you affirm, represent, and warrant that:

1. you are (or your Organization is) the creator and owner of the User Content, or have the necessary licenses, rights, consents, and permissions to authorize Sikh Time and users of the Service to use and distribute your User Content as necessary to exercise the licenses granted by you in this Section, in the manner contemplated by Sikh Time, the Service, and these Terms;
2. your User Content, and the use of your User Content as contemplated by these Terms, does not and will not: (i) infringe, violate, or misappropriate any third party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) breach any contractual obligation that you owe to a third party, including any Organization; (iii) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; or (iv) cause Sikh Time to violate any law or regulation; and
3. your User Content could not be deemed by a reasonable person to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate.

Content Posted by Others : We are not responsible for, and do not endorse, Content posted by any other person. Accordingly, we may not be held liable, directly or indirectly, for any loss or damage caused to you in connection with any Content posted by another member.

User Content Disclaimer : We are under no obligation to edit or control User Content that you or other users post or publish, and will not be in any way responsible or liable for User Content. Sikh Time may, however, at any time and without prior notice, screen, remove, edit, or block any User Content that in our sole judgment violates these Terms or is otherwise objectionable. You understand that when you use the Service, you may be exposed to User Content from a variety of sources and acknowledge that User Content may be inaccurate, offensive, indecent, or objectionable. You agree to waive, and do waive, any legal or equitable right or remedy you have or may have against Sikh Time with respect to User Content. If notified by a user or content owner that User Content allegedly does not conform to these Terms, we may investigate the allegation and determine in our sole discretion whether to remove the User Content, which we reserve the right to do at any time and without notice. For clarity, Sikh Time does not permit copyright-infringing activities on the Service.

Monitoring Content : Sikh Time does not control and does not have any obligation to monitor: (a) User Content; (b) any content made available by third parties; or (c) the use of the Service by its users. You acknowledge and agree that Sikh Time reserves the right to, and may from time to time, monitor any and all information transmitted or received through the Service for operational and other purposes. If at any time Sikh Time chooses to monitor the content, Sikh Time still assumes no responsibility or liability for content or any loss or damage incurred as a result of the use of content. During monitoring, information may be examined, recorded, copied, and used in accordance with our Privacy Policy.

Communications

Push Notifications : When you install our app on your mobile device, you may choose to receive push notifications, which are messages an app sends you on your mobile device when the app is not on. In addition to the foregoing push notifications, you may receive notifications on your other computer hardware device (e.g., laptop, desktop, or tablet). You can turn notifications on or off by visiting your the device’s “settings” page.

Email : We may send you emails concerning our products and services, as well as those of third parties. You may opt out of promotional emails by following the unsubscribe instructions in the promotional email itself.

Social Networks : The Service may include features that operate in conjunction with certain third party social networking websites that you visit such as Facebook, Instagram, YouTube, Vimeo, and Twitter (“Social Network Features”). While your use of the Social Network Features is governed by these Terms, your access and use of third party social networking sites and the services provided through the Services is governed by the terms of service and other agreements posted on these sites. You are responsible for ensuring that your use of those sites complies with any applicable terms of service or other agreements.

User Warranties and Restrictions 

You represent and warrant that: (a) your use of the Platforms and/or Services will not violate any applicable law or regulation; (b) all information that is submitted to us in connection with the Platforms and/or Services is true, accurate and lawful; (c) use of the content and material you supply does not breach any applicable Agreement and will not cause injury to any person or entity (including that the content or material is not defamatory). If at any time, the information provided by you is found to be false or inaccurate, we will have the right to reject registration, cancel all orders, and restrict you from using the Services and other affiliated services in the future without any prior intimation whatsoever. You agree to indemnify us and our affiliates for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these warranties.

You will use the Platforms for lawful purposes only and will not undertake any activity that is harmful to the Platforms or its content or otherwise not envisaged through the Platforms. You have a limited license to access and use the Platforms solely for the purpose of availing the Services, subject to these Terms of Use.

You will not do any of the following:

• Delete or modify any content on the Platforms, including but not limited to any information regarding the Services, their performance, sales or pricing, legal notices, disclaimers or proprietary notices such as copyright or trademark symbols, logos, that you do not own or have express permission to modify;
• Decompile, reverse engineer, or disassemble the content on the Platforms;
• Use the Services in any way that is unlawful, or harms Reliance or any other person or entity, as determined in Reliance’s sole discretion;
• Use any engine, software, tool, agent or other mechanism (such as spiders, robots, avatars, worms, time bombs, Easter eggs, cancel bots, intelligent agents, etc.) to navigate or search the Platforms;
• Make false or malicious statements against the Services, the Platforms or us;
• Post, copy, submit, upload, distribute, or otherwise transmit or make available any software or other computer files that contain a virus or other harmful component, or otherwise disrupt or damage the Platforms and/or Services or any connected network, or otherwise interfere with any person or entity’s use or enjoyment of the Platforms and/or the Services;
• Introduce any trojans, viruses, any other malicious software, any bots or scrape the Platforms for any information;
• Probe, scan, or test the vulnerability of any system, security or authentication measures implemented by us or otherwise tamper or attempt to tamper with our technological design and architecture;
• Hack into or introduce malicious software of any kind onto the Platforms;
• Gain unauthorized access to, or interfere with, or damage, or disrupt the server on which the details connected to the Services are stored, or any other server, computer, or database connected to the Services; or
• Engage in any form of antisocial, disruptive, or destructive acts, including “flaming,” “spamming,” “flooding,” “trolling,”, “phishing” and “griefing” as those terms are commonly understood and used on the internet.

You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing on or through the Platforms, any information that:

• • • is libellous, defamatory, abusive, threatening, harassing, hateful, and offensive or otherwise violates any law or right of any third-party;
    • belongs to another person and to which you do not have any right;
    • is harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, hateful, relating to or encouraging money laundering or gambling, or otherwise harmful in any manner whatsoever;
    • harms minors in any way;
    • infringes any patent, trademark, copyright or other proprietary rights;
    • violates any law for the time being in force;
    • deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
    • impersonates or defames another person; or
    • contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.

Modification of these Terms

We reserve the right to change these Terms on a going-forward basis at any time. Please check these Terms periodically for changes. If a change to these Terms materially modifies your rights or obligations, we may require that you accept the modified Terms in order to continue to use the Service. Material modifications are effective upon your acceptance of the modified Terms. Immaterial modifications are effective upon publication.

Our Warranties Disclaimers and Liability 

We provide our Services using a commercially reasonable level of care and promise to do our best to make sure you enjoy the Services. But there are certain things that we don’t promise about our Services.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OF SERVICE, NEITHER SIKH TIME, NOR ITS AGENTS OR SERVICE PROVIDERS MAKE ANY SPECIFIC PROMISES ABOUT THE SITES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SITES, THE SPECIFIC FUNCTION OF THE SITES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SITES “AS IS”

LIABILITY FOR OUR SERVICES : EXCEPT WHERE PROHIBITED, THE SERVICES ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SITES OR ANY THIRD PARTY’S USE OF THE SITES. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, COMPUTER FAILURE, OR THE VIOLATION OF YOUR RIGHTS BY ANY THIRD PARTY, EVEN IF THE SERVICES ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED.

Term, Termination and Modification of the Service

Term : These Terms are effective beginning when you accept the Terms or first download, install, access, or use the Service, and ending when terminated as described in Section.

Termination :  If you violate any provision of these Terms, your authorization to access the Service and these Terms automatically terminate. In addition, Sikh Time may, at its sole discretion, terminate these Terms or your account on the Service, or suspend or terminate your access to the Service, at any time for any reason or no reason, with or without notice. Sikh Time is under no obligation to maintain or provide any User Content that was contained in a our any services after termination.

Effect of Termination :  Upon termination of these Terms: (a) your license rights will terminate and you must immediately cease all use of the Service; (b) you will no longer be authorized to access your account or the Service; (c) you must pay Sikh Time all payment obligations that accrued prior to termination (all prepaid fees for the Service are non-refundable and non-cancellable 

Modification of the Service : Sikh Time reserves the right to modify or discontinue the Service at any time (including by limiting or discontinuing certain features of the Service), temporarily or permanently, without notice to you. Sikh Time will have no liability for any change to the Service or any suspension or termination of your access to or use of the Service.
